TERMS & CONDITIONS - PITSTOP AI COACHING

Welcome to the Pitstop AI Coach platform. These AI Coach Terms ("AI Terms") apply when you access and use any Pitstop AI Avatars, coaching features, products, software, tools, services, documentation, content, and functionalities provided through our Services (together, "AI Coach Products"). This includes executive coaching, leadership coaching, performance coaching, career development coaching, and other AI-powered coaching interactions.

These AI Terms are incorporated by reference into the Pitstop Terms of Service, available at takeapitstop.com/terms (the "Terms of Service"). If you have an agreement with Pitstop, it also governs your use of these Services. In case of conflict, the AI Terms prevail over conflicting Terms of Service provisions, but only concerning AI Coach Products.

DEFINITIONS

• "AI Coach Products", all AI-powered coaching avatars, software, tools, services, content, and coaching features provided by Pitstop that make use of proprietary Coach intellectual property and session data;
• "Coach", the individual or organization using or licensing their coaching content for AI Coach Products;
• "Coach IP", all original coaching content, methodologies, training materials, session recordings, likeness, and intellectual property owned by the Coach;
• "Inputs", information you provide during coaching interactions, including text, goals, challenges, and performance data;
• "Outputs", the coaching guidance, suggestions, and responses generated by the AI Coach Products based on your Inputs;
• "Platform", the technology and infrastructure operated by Pitstop to deliver AI Coach Products, including website and related applications;
• "Live Session Data", recordings, transcripts, and other interaction data generated during coaching sessions;
• "Third Party Providers", external AI service providers such as Noesis Tech and their Brainstormer platform supplying foundational AI technology;
• "Privacy Policy", our data privacy practices are explained in the Privacy Policy at takeapitstop.com/privacy

Use Restrictions

Your use of AI Coach Products must comply with the Pitstop Terms of Service. You agree not to use AI Coach Products to:

• Generate content that promotes harm, discrimination, harassment, bullying, or offensive material.
• Share pornographic or explicit content.
• Violate intellectual property, privacy, or confidentiality rights.
• Create hateful content targeting protected groups based on race, ethnicity, religion, disability, gender, age, or sexual orientation.
• Use the AI Coach Products for political campaigning, lobbying, or provide licensed professional advice outside coaching.
• Include or attempt to process regulated data, biometric identifiers, health data subject to privacy laws, or sensitive personal information.
• Engage in illegal activities or mislead others.

You must not hack, reverse engineer, sublicense, resell, or interfere with AI Coach Product functionality.

Any of your prompts, coaching interactions, and the results generated by AI Coach Products may be reviewed through both automated (e.g., machine learning) and manual methods for abuse prevention, content filtering, and quality assurance purposes. Pitstop reserves the right to investigate and take appropriate legal action against anyone who, in Pitstop's sole discretion, violates this provision, including without limitation, removing the offending content from the Service, suspending or terminating the account of such violators and reporting you to the law enforcement authorities.

Inputs and Outputs

• Inputs you provide during coaching interactions will be processed as User Content under the Terms of Service.
• You must ensure Inputs do not infringe third-party rights or violate laws or policies.
• AI Coach Products generate Outputs based on Inputs. These Outputs may not be unique and should be used as informational guidance only.
• The AI Coach cannot replace human judgment, emotional intelligence, or the complex interpersonal dynamics of professional human coaching relationships;
• Coaching Outputs are for informational and developmental purposes only and should be evaluated within the context of your specific circumstances;
• You are responsible for the use and application of all Inputs and Outputs.

Third Party Providers

• Pitstop AI Coach Products utilize underlying technology from third parties, notably Noesis Tech's Brainstormer engine.
• You are responsible for complying with any terms or acceptable use policies set by third-party providers.
• Pitstop disclaims liability for content, services, or features provided by third parties. You use these integrations at your own risk.
• Any changes to third-party services may affect how Pitstop AI Coach Products function.

Privacy and Data Handling

The Privacy Policy (available at takeapitstop.com/privacy) governs your use and our processing of personal information related to the AI Coach Products, including any personal information that may be contained in the Inputs or generated through coaching interactions.

Coaching-Specific Privacy Considerations:

• Your conversations, goals, and challenges are processed to personalize your coaching experience and improve service quality.
• Conversation logs and developmental progress may be retained and anonymized to help improve platform and AI performance.
• Do not share information or data you do not want retained or used for personalization or service analysis.
• We never sell, trade, or share identifiable session data outside our service, with rare exceptions for quality assurance or required legal purposes.
• Do not transmit passwords, account identifiers, confidential business details, or sensitive authentication data in coaching sessions.
• Team members may access conversations only for quality assurance reasons.
• Use discretion with sensitive or confidential information.

Disclaimers and Limitations

Your use of the AI Coach products is at your sole risk. The AI Coach products and outputs are provided on an "as is" and "as available" basis.

Standard Disclaimers:

Except as otherwise expressly provided herein, Pitstop expressly disclaims all warranties of any kind, whether express, implied or statutory, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. Pitstop makes no warranty that (i) the AI Coach products or outputs will meet your specific coaching requirements, (ii) the AI Coach products or outputs will be uninterrupted, timely, secure, or error-free, (iii) the coaching guidance that may be obtained from the use of the AI Coach products or the outputs will be accurate, reliable, or suitable for your particular circumstances, or (iv) the quality of any coaching, guidance, information, or other material provided through the AI Coach products will meet your expectations.

Coaching-Specific Disclaimers:

• The AI Coach Products provide general coaching guidance and developmental support. They are not a substitute for licensed professional services including therapy, counseling, psychiatric treatment, medical advice, legal counsel, or financial advisory services;
• Your use of the AI Coach Products does not create a professional coaching relationship, therapeutic relationship, attorney-client privilege, doctor-patient relationship, or any other confidential professional relationship;
• Emergency Limitations: The AI Coach Products are not designed for crisis intervention or emergency situations. If you are experiencing a mental health crisis, suicidal ideation, or any other emergency, contact your local emergency services or a qualified mental health professional immediately;
• Accuracy and Suitability: You are responsible for evaluating and independently verifying the accuracy and suitability of all coaching advice, suggestions, and guidance provided by the AI Coach Products for your specific situation;
• Human Oversight Required: AI coaching should complement, not replace, human judgment and professional oversight. We recommend incorporating human coach supervision or consultation for complex coaching needs;
• Bias and Limitations: AI systems may reflect biases present in training data and may not fully understand cultural contexts, individual nuances, or complex personal circumstances that affect coaching outcomes.

The AI Coach Products may generate content that you consider to be inadequate, inappropriate, or objectionable, and/or that do not represent the views of Pitstop, our partners, Noesis Tech, or our personnel. The coaching Outputs do not reflect the views or professional opinions of Pitstop, our partners, Noesis Tech, or our personnel.

Professional Development Context:

You understand that coaching Outputs may not account for:

• Your organization's specific culture, policies, or strategic context;
• Complex interpersonal dynamics in your workplace;
• Legal, regulatory, or compliance considerations specific to your industry;
• The full context of your personal and professional circumstances.

You recognize and agree that you are solely responsible for your use of, and/or any actions you take in relation to, coaching guidance generated by the AI Coach products based on your inputs. You also recognize and assume the risk that the coaching guidance you receive might not be suitable for your specific circumstances and that implementation of AI-generated coaching advice is undertaken at your own risk.

Ethical Use and Professional Standards

When using AI Coach Products in professional contexts where others may be affected by the coaching guidance received, you agree to:

• Disclose when coaching advice or developmental strategies were AI-generated, where appropriate and professional standards require such disclosure;
• Exercise professional judgment in determining how to implement AI-generated coaching suggestions within your organizational context;
• Maintain appropriate boundaries between AI coaching support and human professional relationships.
• Apply professional judgment when implementing AI suggestions in any organizational or team context.
• Maintain proper boundaries between automated coaching and any professional or personal relationships.
• Effective coaching depends on your honest engagement, self-reflection, and accountability.

Disputes arising under these AI Terms are subject to the resolution mechanisms in our Terms of Service.

Modifications to the AI Terms

Pitstop may change these AI Terms at our discretion. Updates will be posted here with the latest revision date, and may be announced through the service interface or email. Any changes become effective at least fourteen (14) days after posting, unless necessary for new functions or legal obligations which may take effect immediately. Continued use of AI Coach Products after changes means you accept the updated AI Terms.
